What are Care Proceedings?

If your child has been taken into care or social services are threatening to take them into care, then you should seek legal advice immediately.

Care proceedings are when social services make an application to the court to determine whether a child/ren has/have suffered significant harm or are at risk of suffering significant harm from their parents’ acts or omissions.

Before this can go to court, your child’s social worker will have to send papers explaining why they are worried about your child. The papers will be sent both to you and the court. It is essential that you contact a Childcare specialist Solicitor at this stage.

At the initial hearing, the Family Court will make a number of decisions, including whether an Interim Care Order or Supervision Order should be made, where your child should live until the final hearing and what level of contact you should have.
